Insurance Bad Faith

In every insurance contract there is, implied by law, a "covenant of good faith and fair dealing." Often times, when a consumer or a business is mistreated by their insurance carrier, this covenant of "good faith" and "fair dealing" has been violated. Some examples of this include an insurance company that denies an insured benefits that are due under their policy, an insurance company that attempts to offer less monies than are due under the policy and an insurance company that unreasonably delays payment to an insured. All of these actions frustrate the insured's right to receive their proper benefits under their insurance contract. These tactics are actionable in tort and often justify punitive (punishment) damages.
